1. Acceptance of Terms

By accessing, using, or registering for Luna Launch ("Platform", "Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our Platform.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and Luna Launch. Your access to and use of the Platform is conditioned on your acceptance of and compliance with these Terms.

2. Description of Services

Luna Launch provides a decentralized platform for creating, deploying, and managing Solana-based tokens and cryptocurrencies. Our services include:

• Token creation and deployment tools
• Metadata management and customization
• Liquidity pool creation and management
• Social media integration for token projects
• Authority revocation services for enhanced security
• AI-powered logo generation (when available)

Important Disclaimers: We do not guarantee the success, profitability, or market performance of any tokens created using our Platform. Cryptocurrency investments are highly speculative and carry substantial risk of loss.

3. Eligibility and Account Requirements

To use our Platform, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using cryptocurrency services in your jurisdiction
• Possess a compatible Solana wallet (e.g., Phantom, Solflare)
• Comply with all applicable laws and regulations

You are responsible for maintaining the security of your wallet and private keys. We cannot recover lost wallets or private keys.

4. User Responsibilities and Prohibited Activities

You agree to:

• Use the Platform only for lawful purposes
• Provide accurate and truthful information
• Comply with all applicable laws, including securities, tax, and anti-money laundering regulations
• Respect intellectual property rights of others
• Maintain the confidentiality of your wallet credentials

You agree NOT to:

• Create tokens that violate intellectual property rights
• Use the Platform for fraudulent, deceptive, or illegal activities
• Create tokens designed to scam or defraud investors
• Engage in market manipulation or pump-and-dump schemes
• Use the Platform to circumvent securities regulations
• Upload malicious content or attempt to compromise Platform security
• Impersonate others or create misleading token representations
• Use automated systems to abuse the Platform

5. Fees and Payments

Our Platform operates on a fee-based model with transparent pricing:

• Base token creation fee: 0.3 SOL (includes standard authority revocations)
• Additional features may incur extra fees as displayed on the Platform
• All fees are payable in SOL and are non-refundable
• Fees do not include blockchain transaction costs (gas fees)
• We reserve the right to modify fees with reasonable notice

Failed transactions due to insufficient funds or network issues may still incur blockchain fees, which are not refundable by Luna Launch.

6. Intellectual Property Rights

You retain ownership of content you create (token names, symbols, descriptions, logos). However, you grant us a limited license to display and process this content as necessary to provide our services.

You represent that you have the right to use all content you upload and that such content does not infringe upon the rights of any third party.

Luna Launch owns all rights to the Platform software, design, trademarks, and proprietary technology.

7. Risk Disclosures

Cryptocurrency and blockchain technology involve significant risks:

• Financial Risk: Token values can be highly volatile and may lose all value
• Regulatory Risk: Cryptocurrency regulations vary by jurisdiction and may change
• Technical Risk: Smart contracts and blockchain networks may have vulnerabilities
• Market Risk: Liquidity may be limited, affecting your ability to trade tokens
• Operational Risk: The Platform may experience downtime or technical issues

You acknowledge these risks and agree that you are solely responsible for evaluating the risks and merits of any token creation or investment.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Luna Launch provides services "AS IS" without warranties of any kind
• We are not liable for any direct, indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees you paid to us in the 12 months preceding the claim
• We are not responsible for blockchain network failures, wallet malfunctions, or third-party services
• We do not guarantee the performance, security, or functionality of tokens created on our Platform

This limitation applies even if we have been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless Luna Launch and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of applicable laws or regulations
• Any tokens you create or distribute
• Any content you upload or submit

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Platform, you consent to the collection and use of information as outlined in our Privacy Policy.

11. Platform Availability and Modifications

We strive to maintain Platform availability but cannot guarantee uninterrupted service. We may:

• Modify, suspend, or discontinue the Platform at any time
• Implement maintenance or updates that may temporarily affect service
• Change features, functionality, or user interfaces
• Set usage limits or restrictions

We will provide reasonable notice for significant changes when possible.

12. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, for:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Regulatory requirements
• Extended periods of inactivity

Upon termination, your right to use the Platform ceases immediately. Provisions regarding liability, indemnification, and dispute resolution survive termination.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration rather than in court, except where prohibited by law. The arbitration shall be conducted in accordance with the rules of a recognized arbitration organization.

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, blockchain network failures, or other force majeure events.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.

17. Governing Law
